The prayer of the petitioner in the present writ petition is for
computing her service as a daily wager towards qualifying service for
The learned State counsel has not disputed that as per Rule
3.17-A of the Punjab Civil Services Rules (as applicable to Haryana), the
service as a daily wager is to be computed as qualifying service for the grant
of pensionary benefits.
It being so, the daily wage service of the petitioner is liable to
be computed as qualifying service towards grant of pension and other retiral
benefits. Accordingly, the present writ petition is allowed. Since the
petitioner retired from service on 31.10.2010 and she filed the present writ
petition in the year 2016, therefore, the arrears will be restricted to 38
months before the filing of the present writ petition.
