Petitioner, who is wife of respondent, seeks transfer of
proceedings under section 9 of the Act pending at Bathinda to Patiala.
Learned counsel for the applicant submits that the jurisdiction
of Bathinda court is not made out. He submits that applicant has two
children to look after and she is living alone in Patiala. It would be difficult
for her to defend the proceedings at Bathinda, keeping in view her
responsibilities.
Respondent remains unrepresented despite service. This
petition is, thus, allowed. It is directed that the proceedings under section 9
of the Act pending at Bathinda be transferred to competent court at Patiala.
