Instant writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari setting aside the impugned order dated 16.04.2013 (Annexure P/7) passed by respondent no.2 – Commissioner, Hisar Division, Hisar vide which partition proceedings finalized by respondent no.5 – Assistant Collector 2nd Grade, Tohana has been set aside.Learned counsel for the petitioner, after arguing for some time, states that petitioner has already approached the Financial Commissioner, Haryana against the orders passed by the Commissioner and other authorities. Learned counsel further states that revision petition has not been decided till date by the Financial Commissioner, although was filed on 18.07.2013.

On the asking of the Court, Mr. Rajneesh Chadwal, Deputy Advocate General, Haryana, accepts notice on behalf of respondents no.1 to 5.
Having heard learned counsel for the parties and after perusal of the paper-book, instant writ petition is disposed of with a direction to the Financial Commissioner, Haryana, to pre-pone the date in the revision petition filed by the petitioner, if already given by him or by the ministerial staff and take up for consideration. Needful shall be done
within a period of 15 days from the date of receipt of certified copy of this order.
